I am sure they lost the deal after their single managed only 51 in the Charts.Not good enough for a band around for 3 years and was on XFactor.
The music industry is a brutal and ruthless business and labels are nothing more than a mortgage lender, give you money in one hand and want it back with interest in the other, the pressure to succeed is tremendous and you've got to feel sympathy with the acts when it all ends in tears (& debt).

As far as I am aware though, if a record fails in the charts, it's the Record Label rather than the artist that pays for the loss.

Record labels are a business and to put out a successful single costs thousands on studio time, making of a video, pressing of the CD, photo shoot, then then you need a plugger to take it to the radio stations add on advertising and you could be into a few hundred thousand, no business in the world could survive by taking that kind of hit, a record label lends you the money.

The Record Label pays itself first including costs.It is possible that OTY came out with nothing.

It must've been really guttng for them to spend the last few years of working really hard to build up a fanbase, after finally getting a single out and watch it miss the top 40.. must just feel like what's the point? It'd be an uphill struggle for them now if EastWest had dropped them.

Exactly, they want to recoup their money before the band, add percentages for producer, manager and publisher and a No. 51 hit in the charts ain't going to see the band in a lap of luxury.
