It is/was because some of the WiMax is deployed on spectrum that was auctioned for "educational" use, and Sprint doesn't own it, a few middlemen do - and as part of the agreement Sprint had to give those organisations access to the resulting network to provide low cost internet access for rural schools, teachers, etc.

Sprint did so with WiMax but did not arrange an amicable solution for LTE, so the spectrum holders went to court to get an injunction

I believe the solution was full speed LTE until 30GB for the educational use and then at restricted speeds or something like that.

US spectrum IMO is a mess, spectrum squatters and the like.

CA is working giving them 2 carriers of 20MHz TDD and they're planning to rollout a third when devices support it.

Even allowing for state-by-state regional licensing (something that isn't limited to the USA, it's done in Canada & Australia as well), the bandplan for their 700MHz auction was a major mess. When you have Mexico, a country that pretty much adopts its approach to spectrum licensing to mirror that of its northern neighbour, decided to licence its 700MHz band under the APT standard, then you know you screwed up.
