But in this case there was concrete proof that he was the killer.

Clearly the law in Scotland is entirely different.....if someone is 'missing' presumed dead, after 7 years the courts will accept that. However in a case of suspected murder it's entirely different. Look at the likes of Peter Tobin, he was convicted & jailed for the murder of several young girls but no bodies were found. It was actually the discovery of another young girl which led to his conviction & subsequence jail sentence. The bodies of several were found several years later but he had already been jailed for the murder of them.
