The crucial evidence was the video, and that was the property of CH5 (or the BOTS producers).
Nothing to do with "Aisleyne's side".

And so it all ends exactly as it obviously would have from the beginning, with a bit of an unexpected sideshow of a possible court case in the middle.

I reckon Aishleyne has enough on production manipulation to make sure they never, ever wanted to go to court, and at the end of the day some behind the scenes 'agreement' meant it ultimately didn't
