Man City are appealing against Aguero's charge. According to some people on twitter they are trying to argue that the referee saw it and chose not to act so Aguero can't be punished. Almost no chance it's successful if that is the defence, for it to work I think the FA would have to entertain the idea that the referee lied in his report, can't see them doing that.

Don't really agree. The point of the frivolous appeal rule was to stop teams trying to delay a ban to get a player to play in a match, that's not what this is. Even if it is a crap defence it's not trying to game the system.

I think they are trying to get him to be able to play in the derby match, I don't think that they mind him missing for the game(s) after that, so I think this could be a delaying tactic.

No they're not. The FA changed it years ago so the process is incredibly quick to avoid anything like that happening and even if they hadn't, the derby is over a week away. To claim that they are trying to get him to play in the derby is idiotic.
Hopefully they come to a conclusion pretty quickly. |

Apologies if my memory is incorrect though . |

Fair enough, I hope that you are right, as there should be no way to get him to play in the derby.

Well , that was my take on the the incident as well . The ref was a few yards away looking straight at them as I recall so he must have seen it and disregarded it , he's unlikely to say he didn't see what happened as I'm fairly sure he was looking straight at them .
Apologies if my memory is incorrect though . |

As I said, they will. Hell, the BBC is saying they'll report tomorrow.
He might have been looking in the general direction but if he didn't see Aguero swing an elbow then he can be banned. And he has said he didn't see what happened, hence the charge. |

Oh well , I still think it's a bit harsh ... he was being battered all through with no protection and presumably just tried to give the other guy a bit back . I don't think he went out to hurt anyone , he didn't even connect with his elbow it was the back of his wrist that connected with the guy's windpipe . I still think it was reckless behaviour which merited a yellow card ..... never a 3 match ban .
It wasn't 'reckless behaviour', it was violent conduct. A mandatory red card, and 3 match ban. |

Being niggled is no defence, even if that actually happened. I watched the game, and don't recall him being singled out for any particular 'treatment'.

Most definitely it was a red card offence, there really is no defence for it, which makes this appeal a tad bit puzzling, you wonder quite how they are going to spin this.

Agree.
I've already posted the rumoured basis for the appeal (you have even replied to it) so I'm not sure why you are puzzled as to how they might spin it. Even though it is a long shot it's worth trying. |

Going by what they're appealing, they've got no argument. If they were trying to appeal for a shorter suspension then they might get somewhere, but even then I don't think they'd win.
As it stands, they aren't going to win that appeal, there's no technicality they could use. Not really sure why they're bothering. |

I wonder why the poster pursuing this matter like a bloodhound didn't have such enthusiasm in questioning Mata's hilarious dive in United's first league game? The one with the almighty yelp of pain and the Sky replay showing that the opponent didn't get even close to Mata's leg. It was almost on par with Vieira's classic back in the day. Both dives raised much mirth and when they're that clear-cut deserve similar retrospective punishment (I'm sure Vieira was actually charged but may be wrong). |

The ref did see it, but bottled it.
City are calling him out on it, expect to see more of this type of defence |

With all due respect , this is the 'neutral' thread and in this instance you're not strictly neutral as being a Man United fan you would clearly prefer KunA to miss the derby ...
