EE Carmel and her Essex house

Correct me if I am wrong but isn't Kush's mum Carmel married to Kush's dad? If she is then tonight's writer should get his legal facts straight before allowing Carmel to utter inaccurate information! Carmel told Kush tonight that Urmah? has sold the house in Essex from under her and she has to get out. That cannot happen as in law if she is married to Urmah and the house is in his sole name, she is legally entitled to at least half of the sale proceeds. By law a spouse cannot be thrown out of the matrimonial home even if the house is in the sole name of the other spouse. When people get married they have rights, something the EE scriptwriters obviously dont know! Carmel would be protected by law as she has some security. I presume the house is in her husband's sole name as if they jointly owned it, he could not sell the property without her consent.

I am sure the EE scriptwriters know the legal rights of spouses, or think they do, as when Janine threw Barry Evans over the cliff, they had only been married for a few days and she managed to inherit all his estate as she was his wife and he died intestate. This was wrong as well because in an intestacy if there are children, the wife and children inherit a certain amount each and it ended up with Barry's son getting nothing which in real life would not have been the case as his son would have inherited a certain amount as well as Janine.

It really annoys me the way EE scriptwriters get legal facts completely wrong as they have done re Carmel and Barry Evans' death. They bend over backwards to get medical matters correct (well most of the time) yet dont bother with the correct facts when it comes to legal matters! Mind you, Corrie is just as bad when it comes to legal matters as well! Rant over!

The legal stuff is nearly as bad as the portrayal of Social Services. Take baby from Lola and give her to alcoholic life long criminal Phil. Take Jade and the pass the parcel that went on with her. JJ given to his Mum straight away.

Disengage brain is the only way.

You have a very valid point, but soaps paint themselves into so many corners they are forced to "play loose and wild" with legality otherwise stories would never knit together.

They have mentioned the divorce a few times and that Umar let her live there rent free until he was selling it which he pushed back when Shabnam was pregnant / lost the baby and Carmel decided to go help them

To be fair they know nothing about marriage on Eastenders, they let two divorcee's(Roxy and Alfie) get married in a Church which isn't their local parish church without any form of qualifying connection, without banns being read. They seem to think that you can get married at short notice when Churches and Registry offices are booked up months in advance and registry offices have to list the notice of intended marriage for a certain length of time and the couple have to go for an interview. Churches also have to read the banns for 3 consecutive weeks normally two months before the wedding. But in Eastenders land they can get married the next week.

You have a very valid point, but soaps paint themselves into so many corners they are forced to "play loose and wild" with legality otherwise stories would never knit together.
Indeed, like the time Phil was convicted of armed robbery, and later violently escaped from prison, yet a few months later was released on some kind of technicality that was never explained!

The best thing to do is just accept that is all fictional and none of these trivialities should bother you, that's what I do it makes watching them much more relaxing and enjoyable.

They're divorced. Her ex husband was allowing her to live in their former home.

They're rubbish with legal matters. Mick bought the Vic with a bagful of cash...no paper work involved. Ian recently sold the restaurant that he jointly owned with Jane against her will and behind her back. Phil offers to give Sharon half of everything and the next day she's got half a million in her pocket...

I remember when Alfie threw Kat out of the Vic...they were joint tenants, joint landlords and it was her money that bought the lease. Yet he threw Kat out, moved another woman in, and put her name above the door.
