Love's argument would be if the BBC treated it like an entertainment format rather than factual they would have been able to spend more on it, even if they weren't able to match Channel 4 moving closer to Love's valuation may have resulted in a positive result for the BBC. I add this is probably Love's argument rather than my own. If Kudos couldn't reach an agreement with ITV over Braodchurch the same would have happened.
Additionally, Love want to make the most of the commercial power from Bake Off, something the BBC cannot offer - admittedly the BBC could and can do nothing about this.
As I said before I'll be interested to see how the BBC deals with indies now in terms olf drawing up contracts. But when they're letting Love off the hook by seemingly not asking them to honour the 'one year's break' deal...
