The complainant was probably some pissed off customer who got kicked off the one plan, don't agree with the ASA's ruling on this one.

I disagree with the assessment that this is an unjust ruling.

IMO they've been walking on thin ice trying to argue that "all you can eat" does not mean "unlimited" and at least now that's been clarified.

Totally just and correct ruling, anyone who actually bothered to read the judgement can see where Three were wrong.

Must add, Three really have turned into the rear end of the mobile industry, nice what they think of their customers who download any P2P files.

The ads must not appear again in the form complained about. We told Hutchison 3G UK Ltd to ensure that future ads did not use "unlimited data" claims, including "all-you-can-eat data," unless they could demonstrate that TrafficSense only affected illegitimate use of the service or that any effect on legitimate use was moderate only. We also told them to ensure that any caps on tethering use as part of otherwise unlimited data plans were included in the headline claim.
I'll be watching their adverts, any new ones that claim "unlimited" or "all you can eat" data or don't include the tethering restriction in the headline need to be flagged up to the ASA.

Is the end of all you can eat data on the horizon? Can honestly see it either going up in price even more or being withdrawn all together... wonder if the person complaining then would complain about all-you-can-eat data plans disappearing. Most the people that hate Three at the moment are just people that are salty about having their cheapo internet connection taken away from them.

Hear hear!

All you can eat data has been on the chopping block for the last 2 years now, it is coming to an end as Three moves with the rest of the market in offering fixed data plans. That isn't necessarily a bad thing either, Three are one of the most generous in terms of data compared to the rest of the market. However if they offer fixed data, it should be unrestricted in how you use that, so say you have 15GB allowance you should be able to use that for tethering and P2P is need be.

It's a very interesting outcome but it's clearly directed more at Traffic Sense rather than the actual "All you can eat" claim.

On the plan details it did clearly state and in the terms and conditions that you had a limited "hotspot usage" and it wasn't the same as phone usage.

It's obvious most P2P downloads are illegal it's a high percentage maybe not as high as "99%" as what Three UK claim, as many game updates which was mentioned in the complaint use P2P with the addition of Linux Distributions. P2P tend to be ideal for "Large Downloads" rather than downloading and hammering one server you have the ability to upload and download from different servers and locations (Peers and Seeders), I back Three up on blocking P2P for the reasons of people hammering the network and affecting the ability of other users.

As for the "All you can eat" it implies unlimited but a business can make a decision to exclude a customer from there services at any time, I think the soft cap of "1000GB" which is only in place to "Identify Commercial use of the services" is a little harsh, I don't see any other network offering near enough 20GB+ especially without been throtled.

Always remember though a Mobile network will never fully be able to support "unlimited" for everyone, there will always be speed caps, some sort of limitations in place, there just isn't enough spectrum available to support it.

From what I've heard on here, this would probably be more of a priority than the AYCE data thing. After all, on Three, data to the handset is unlimited, with a separate allowance for tethering (which has now been increased to 30GB on new plans). Whereas, in regards to Feel At Home, I've heard that data has been unbearably slow to the point of unusable (and that it would likely be better to buy a cheap PAYG SIM in said other country, and top it up).

It hasn't disappeared from PAYG. Except there is only 1 PAYG AYCE data tariff now (the All In One 25) rather than 2.

The ex All In One 15 now being All In One 20 with 12GB of data instead of AYCE data (they did still offer AYCE data for a time when the All In one 15 increased in price to become the All In One 20) is still good value really. Just hope they don't increase the price of it again and then also cut the data down to 6GB, and then again to 3GB together with a further price increase.

So it was (if I read it right) not to do with the actual data used on the phone / ipad or whatever, but the tethering part that could be used by any Tom Dick and Harry ?
