Talk Talk have just sent me a bill for £75 for the crappy box they provided me with 3 years ago, thing is they have not even asked or give me the option to return the box to them just billed me for it, the box itself is back in the box it came in on top of the wardrobe!

do you think they would cancel the bill if I sent it back? or is this just sour grapes from them after I left them!

I think it is certainly worth a phone call at least. I am surprised that they have charged you for the box. After three years, it must have exhausted its value - even if it spent them on top of your wardrobe.

You probably had a free box as part of a contract (18 months in my case). If you cancelled after the contract completed, they shouldn't be asking for any money. If you cancelled before the end of the contract, they are within their rights to ask for the money.

It doesn't say in the T&C whether a person can return the so-called £75 box to avoid the fee. I imagine they must take the box back if a person does not wish to keep it.

However the OP says this began 3 years ago, so the 18month min term no longer applies and the box is the customers outright.

I don't know how Talk Talk are managing to justify this scam, perhaps have a chat with them...

Looks like they put me on a new contract when I moved last year so technically I was still within the minimum term by 1 month even though I had no contract before I moved they imposed a new contract on me because I was nice enough to take them with me to the new house!!!!!!

I said the box was out of contract over a year ago but because they imposed a new 18 month contract on me it put the pile of crap back in contract!

Lesson here is if you are with Talk Talk and not in contract with them, and are going to be moving house DON'T take them with you, go somewhere else instead!

Offer to pay for the extra month - assuming that you haven't been billed for that already and then take them to the ombudsman.

They should only charge you what they lose by you 'cancelling early'.

So what law says if you hire something for a minimum term contract that something becomes yours at the end of the contract?

When ever I have hired a car for a week I have never been given the car outright at the end of the week.

If the box is rented then yes you would have to give it back. Virginmedia TV and Sky Q boxes are rented. Sky HD, talktalk and BT give you the boxes, on credit, so at the end of the contract you own them outright. Just a different way of doing things.

I suppose a person could argue if they were placed in a new 18 month contract when a previous contract had expired the minimum terms, why therefore they were not given another receiver in the new contract terms were exactly the same as the first?. As if the monthly fee includes covering the cost of the receiver, well if after the minimal terms or contract renewal the charge remains the same or does not drop to reflect the receiver cost has been covered or reflect your using current or old equipment I'd be asking questions myself under threat to walk away!.

Ok, seems op never realised the contract had been renewed as such. But since they had moved then seeing or assuming they appear to have been given a fresh new contract at the new address than a direct transfer of the old expired minimum terms contract etc. Well I'd ask and point out were was the supplied new receiver under the terms of a fresh new contract, as none was ever provided or received under the new\renewal and thus not liable for this charge.
