I thought he told her she had to pay for the sandwich or whatever it was she was eating. He didn't say theft, IIRC, and it isn't legally theft unless you attempt to leave the premises without paying. So he wouldn't have a leg to stand on.
If she didn't take the pasty out of the shop, can it be called theft though? She still had opportunity to pay.
