Accident and in Hospital

I am looking for advice, my good friend had a road traffic accident, is now in hospital with serious injuries. he works 16hrs a week and does ot get sick pay as the company is very small, he also gets a small housing benefit for his privately rented flat.

Its likely he will loose his job as he will be off for about 5/6 months. He is petrified of losing his flat, can he get in touch with someone to discuss so that if he does lose his job his flat is paid for until he finds work again following recovery.

He needs to get in touch with his insurers (if he was driving) or the other party's insurers and establish a personal injuries claim. Some reputable insurers ( providing liability is admitted by them) will issue interim payments, which will eventually be deducted from the final claim.

If he is off work and cannot pay his house rental, he should get in touch with social services - or even t he Citizens Advice Bureaux.

You may need to get written authority from him to act on your behalf.

You are assuming he wasn't at fault.

When you say he isn't getting sick pay, he is getting SSP isn't he?

How long has he worked for the company?

He was at fault, its more to do with keeping a roof over his head at the moment

Yep, should get Statutory Sick Pay.

I doubt the company has an accident policy for employees, but may as well ask.

Does he have an income protection policy?

If he's already getting some Housing Benefit, it's simply a matter of reporting a change of circumstances (such as a drop in income) and they'll recalculate. HB is capped and may not cover the full rent of privately rented accommodation so none of us can tell you any more than that without much more detail.

If he's been earning £112 or more pw, he should get SSP. If he hasn't, his employer should issue a form called an SSP1, saying that he doesn't qualify for SSP. Then he can claim ESA (he'll need a medical certificate and it can be backdated for, I think, up to 3 months).

Regardless of whether he's on ESA or SSP, and providing he doesn't have savings of more than £16,000, he should also be entitled to housing benefit and probably a reduction in his council tax, although that depends on the scheme operated by his local council.

HB can often be claimed online, ESA has to be done over the phone.
