l recently bought a second hand car, which l took for a test drive. The car seemed ok and the mileage wasnt too high for lts year. l asked the seller wee there any problems at all wlth the car, which l was told there wasn't.

For peace of mind l took it to my local garage and when they put it up on the ramp, they found a catalogue of faults. Dome being the 4 tyres were illegal, one was actually cracked. There were also 2 issues with the exhaust.

l contacted the seller, who reluctantly asked me to take the car back in and he would flx the tyres.
Yesterday l was back in for something else and was told, that l had bought the car, and due to wear and tear he wasnt fixing it.

l bought lt 20 days ago, and feel that what he's saying ls nonsense. l am going back ln soon, and wondering lf l have rights. He assures me l have none.

On the assumption that you bought it with a valid MOT on it, had you contacted Trading Standards before the guy had 'fixed' the tyres, I'd have thought that you had a cast iron case.
If the prevailing faults are MOT related, I'd try that route anyway, even if they're not, it sounds like it isn't fit for purpose.

All an MOT proves is that the car passed the test on the date the certificate was issued. It says nothing about the road-worthiness now as the MOT could be 11 months old. I'd always want a new (at least in the last month) MOT on any car I was buying.

Most people with a car that needs work will try and sell it it on and thus being a private sale have very little legal ammo to complain with. Always ask your self would you lie to get rid of a car with a few problems?

Thanks for the replies. l took it down earlier and he has said he will flx some of the issues but not them all. l have decided when the registration document comes in l am taking lt back for my money back. He has sald fine.

The MOT was done on 1st November this year with no advisories, which ls strange as a back tyre was cracked another nearly as bad. The exhaust has holes in 2 places which according to my local garage said that should never have passed an MOT, the MOT ls legit l have checked that out online.

All in all l was sold a car that definitely wasnt legal for drlvlng wlth the tyres alone.

If he's a trade dealer you can get a full refund if he's unwilling to make the repairs.

He'll most likely refund you and hope to sell it on to someone else who isn't as dilligent as you have been.

I complained once and had my 'new' 2nd hand banger (bought from a Dealer) examined by a Council Test Centre

The Dealer and a burly mate turned up for the inspection too.
Sadly, my collapsed suspension bulkhead was deemed not detectable, due to inaccessability, in the recent MOT and 'could have happened after I bought the car'

I'd had it one week, and the problem was only noticeable on a dual-carriageway at 60mph+
when the back end started 'dancing' from side to side.

I never did get my £400 back. (1987)

In your case, your faults sound to me eminently detectable and you have a falsely issued MOT.

Surely depends if it was sold as seen or not, most private sales they are sas and you have little to no comback.

Download the App 'Vehicle Smart', pop your reg number and car make into it and it'll show you previous MOT history and mileage data. When I was selling a previous car, a potential seller showed me a screenshot from the app which showed my car had previously been clocked - I was totally unaware of this!!!

This might show anything untoward about the car's history,

l felt very intimidated by hlm, but stood my ground on what l know about cars (due to having brothers, 1 a mechanic). For what l pald for the car lt should never have had faulty tyres, and certainly not cracked. Nor should lt have had a faulty exhaust.
The Engine Maintenance light has been on since he supposedly fixed the exhaust yesterday.
To say he wasn't amused, is an understatement, but l won't be fobbed off by a blg burly man that thinks he knows best .

None of us should accept goods not flt for purpose no matter the cost. Some people unfortunately slt back and don't say anything.

Yes, l realise some faults are not detectable. But mine were as he told me lt had been up on the ramp and no faults were found. Blt bizarre not to have noticed 2 cracked tyres though, or a faulty exhaust. says a lot about the mechanics he uses!

You can also get the same information from the DVLA website without downloading an app: https://www.gov.uk/check-mot-history

Sorry to hear of this. Damn annoying those car dealers who "try" to take advantage of women. Unfortunately it's happened to ex's and women in my family in the past! On a number of occasions.

I would say always take a guy with you when buying a car. But clearly no female should need to do that. Just to stop some bullshitter guy!! There are to many dodgy car dealers out there.

What makes you think he was just trying to take advantage of a woman? He probably does it to any customer who doesn't know what they're talking about. You say always take a guy with you but most blokes wouldn't know anything anway. Although next time she should definitely take her brother.

Because these types of guys, naively think women are more likely to be susceptible to the bullshit! Which is stupid on the dealers part.

You are no doubt correct. But like any of us, we can only go by the stories that we personally know of.

Simon has been working nights, or he would have been with me. l can usually hold my own, even though l am pint size . But he wasn't for budging at flrst. l got there eventually.

As that other commenter mentioned always check the MOT history and not just the most recent one. When I was looking for a second hand car a couple of years ago there was one car where the latest MOT had no advisories, whereas the previous ones had multiple issues including serious structural problems, which all seemed to have been magically fixed.

I think that some second hand car dealers have mates who will do a "special" MOT for them to give their cars a clean bill of health.
