I thought it was only if the father is named on teh birth certificate, otherwise someone could just name any man as the father of her child and get him to pay her maintenance.

Well, despite the difficulties in getting a person to pay maintenance in the first place, there are procedures like DNA tests, etc. to go through before you can be 'forced' to pay.

In the scenario you were replying to, though - there'd be good reason to go to court to present the case.
