Yes they can set whatever tariffs they agree to mutually. That's not what Trump's saying though - he's threatening to put a 25% punitive import tax on Mexican goods, with no hint of mutual agreement about it. The Japanese don't seem to be buying it, so they presumably also know about WTO rules.
