Depends on the context: remember you sue the PUBLISHER in a libel action, as well as the, er, person who says it.
If you were down the pub drinking and said, jokingly, "me, i knicked loads of stuff from work, and they'll know nowt about it" (as I'm sure you talk like that!!), but someone wrote it down, and then published it, you'd sue the publisher.
You obvioulsy wouldn't sue yourself, and you wouldn't sue if it were TRUE, unless you were Jade!!!
It's mega complicated by such issues as: she knew the camera was there (implied consent) etc etc, and would never succeed in real life: this is just an academic exercise I'm carrying out.

If he did, even if the cameras were off, Kate might still have a cause of action in *slander* if any of the other HMs had heard.
Anyway the point I was trying to make is, people have blamed the silences on possible libel actions etc, so if thats true, why would they not mind the comments that earlier posters say were made?? It's inconsistent, and just convinces me more that c4's lamentable excuses for censorship are aload of b-locks.
Here's a question: assuming alex is not gay, what possible causes of action could he have if Spencer carved "alex is a gay minger" in the table?
I'm just thinking out loud as I know nothing of the circumstances
