i purchased a k750i off a seller on ebay the phone was advertised as new working etc the seller has only been member since this sept i took a chance on the purchase i should not have with hindsight as they only took cheques and not paypal, i sent them a cheque waited then phone arrived i put my sim in and it read (inactive sim) i rang orange they told me it was blacklisted i as gutted, £170 i paid for it.
i rang the seller and told them what orange said, theysaid it was wrong they would ring ornage and get back to me get it sorted and get the blacklising off etc. i waited after a few
hours i rang the seller again to ask for a refund they hung up now they dont answer. what can i do they cheque has gone through already. how could i get my money back whats involved how long does it take im gutted.

The perils of not testing out a product before you pay for it.

Its very difficult to get your money back as your paid by cheque and not credit card.

The best thing to do is to complain to Ebay about the vendor and they usually send out an email to them,asking to refund the money or face legal action.

The only way to get your money back is by suing the eBay member.

Either the phone is actually stolen or the phone was probably supplied free by Orange in return for a contract. If the seller has not paid the monthly contract fees then Orange will have blacklisted the phone as they consider it to be stolen from them.

There is no legal way to "reset" the phone (anyone who does this is liable to 5 years in clink). The phone could be used overseas - the blacklisting only currently applies to UK networks, although there are talks of extending this to the rest of Europe.

However, you are currently handling stolen property.

I did post a reply before but it's be removed, maybe because I quoted another reply which has also removed?

However same thing happened to me, contacted the police and did nothing because the phone was barred due to non bill payment. Even though it's fraud in my eyes police did nothing and said it was between me and the buyer.

If the phone is blacklisted then it is cmopletely unusable in the UK, this means it is not the item as described so I would recommend contacting Ebay ASAP and run a seller dispute. It's also perfectly plausible for that amount of money to sue the seller through the smal claims court but that usually shouldn't be necessary if Ebay have the seller's details. If the guy doesn't use Paypal though, they might not have all his details.

the war on ebay with scammers is becoming uncontrolable! Ebay must start taking note of all the threats and start a authorisation scheme or something along them lines!

Ebay should ensure the IMEI is submitted when a auction for a mobile phone is setup. Verfication could be done automatically. If the phone then supplied does not match the ebay recorded one then action could be taken (if the phone is found to be dodgy).

Great idea, don't they do the same for cars? You type in the reg number and get all the details pre filled.

The reg numbers are blanked out in the description page, the same could be done for phones?
