Downloading Music from Myspace.com: Is this Legal?

For a while now I've noticed how easy it is to simply search for an artist and download some of their more popular songs from Myspace.com. But isn't this technically theft? I mean the artists themselves won't be making any money from the downloads of these tracks as the myspace profiles themselves probably aren't genuine.

I enjoy using myspace reguarly to find new music but I did notice that with some of the more popular and internationally known artists and bands there are multiple profiles created by fans and pretenders.

But who would be in the wrong? The people creating these profiles and giving away artists' music for free? Or the downloaders?

If the myspace page is offically run by the band/ artists in question, then it should o.k , they've given permission to everyone to download their material,
If its a fan site though you would assume that they dont have the permission of the artists, therefore making it an illegal download.

It is not illegal.
Any band posting an MP3 immediately hands rights over to Myspace for them to distribute their music anyway they want to, including downloads and using it in ads etc, so you are legally downloading from myspace, not the artists themselves.

Yes, that's what I thought. It's fine if it's the band posting their songs themselves but if it's a fansite then they shouldn't be doing that unless they've obtained permission from the correct people.

It's not illegal to download them, but it's illegal for people to allow them to be downloaded without permission!
