You have to wait until the last month at least! 11th month or 17th month depending if your on a 12 or 18 month contract.

No earlier!!

im due to upgrade on the 30th July.. i asked T-Mobile if i could (as im a loyal customer) and they said they can't.

what about getting 2 contracts?
can we get 2 contracts on the same name?
my mate has about 3 contracts,
he buys 1 contract with latest phone,
when a newer model comes out he sells his current phone and uses that money to pay off his current contract and buys the the newer model?
doesnt that mess up his credit histry?

You appear to have answered your own question there!

great if you can make it pay, but at a minimum typical annual contract rate of £300 p.a and probably an average of £420 p.a., he must know a good place to sell mobile handsets at over the odds prices

As long as the network is getting paid on time every month, it probably improves his credit history.

Note some networks may limit the number of handsets you can have at any one time - if for no other reason than you can't afford to pay that amount of monthly charge based on your income, or otherwise they know you cannot use lots of phones at once so there is no benefit to them to supply you with so many contracts. But if you have a good enough credit rating and have the ability to repay, 2 or 3 contracts are not normally a problem.
1 for you, 1, for your partner, perhaps 1 for another dependent.

why would anyone buy a sim free phone when you can get it cheaper on contract if you take into account all the free minutes

Not anyone can get a contract cos of bad credit and not everyone wants one. Also some people want to upgrade their handset but keep their sim card and don't want all the branding so people buy sim free phones for those reasons and probably others.
