Recording telephone conversations
Is it legal for me to use the voice recording capability of my mobile phone to record a telephone conversation I have with someone?

Depends what your use of it is for.. As far as I know, you should really ask for permission or make it known that the conversation has been recorded.

My uderstanding of the law is that you are breaking the law if you record a phone conversation without the other person's prior permission.

Oddly, telephone recordings are not admissible as legitimate evidence in court, unless there is evidence that the recorded party knew they were being recorded before the start of the conversation. The same does not apply to video evidence. |

According to Which? for whom I've made many secret recordings, it's perfectly legal to tape someone, either in person or over the phone, without their knowledge.

People are confusing English law with US law. Here it is legal, while generally in the US it is not.

As long as one of you knows that the recording is made, you can record the conversation, this must be for your own use, if you want to use the call for others to listen to etc, then you need to inform the other person you are recording the call. |
