Possibly mis-sold contract with T-Mo - anyone else had something like this?

I've recently sent the following complaint thru to T-Mobile and was wondering if anyone else has had the following problem:

"I tried to upgrade this month (12months since I recieved my last upgrade) and I was informed that I have an 18month agreement. Last year I was made a more enticing 12month offer from O2 and served notice to Tmobile. A lady from Tmobile called me back, offering to match the deal and re-signed me giving me the phone that O2 were offering, however at no point did she mention that I was entering into an 18month agreement and on previous occations this upgrade service has only been for 12months therefore I assumed this to still be the case. I understand that you are obliged to inform me at least once during the conversation that it is an 18month deal. Futhermore it doesn't say "18month agreement" anywhere on the paperwork I was sent nor in the Ts&Cs. I feel I have been duped into a longer contract than I feel comfortable with and that this agreement has been missold to me. I need an upgraded phone as the D750i keeps turning itself off (a common problem with this model I now find out) and your repair team have not as yet been able to resolve this issue in 3months... Again further antagonising me. If this matter is not given immediate and equitable attention, I shall be passing the complaint along to oftel. I await your response."

Sorry to start an enormous thread about something which is probably only interesting to me, however i'm so angry with TMo at the moment and can't believe that I'm stuck with a sh*t fone for another 6months and would now be with O2 if they had been upfront with me when I tried to leave... has anyone else had a problem like this? How was it resolved?

Not had this particular problem, but whenever I have had issues with T-mobile, I have contacted their complaints team in a polite but firm manner, like you, and been very pleased with the response. I wouldn't be suprised if you were reverted to a 12 month contract, and offered compensation, together with either a quick fix time on your current handset or a replacement.

I'd be interested to know how you get on.

my sister recently got a sidekick from t mobile with an 18 month term - After one week the hand set went faulty, texts stopped being recieved and delivered and the signal strength was weak, after complaining to a manager that actually agreed to cancel the contract and allow her to return the handset and remove all charges - wasnt easy though, all i would say is anywhere!
