It is thought sales of the tape may have netted the man more than 120,000.

Surely a good lawyer can get the mans bank account frozen if there is a court case going on. It was a horrible thing for him to do and she deserves a lot of compensation.

My take on this: he owned the copy of the tape which was made with Imogen's agreement. It's her word against his that they apparently agreed to destroy all copies. Imogen will need a lot of luck to win; hardly worth the risk of more publicity, bad or otherwise, in my view.

Imogen will earn at least 120,000 indirectly from the tape anyway.The "victims"of these tapes whether they are in on the publication or not,always do well out of them through publicity and notoriety.look at Abi Titmus-it would have been Abi who without the tape.This tape is the best marketing tool Imogen Thomas could have wished for as you could see which market she was looking to appeal to.

Well aisleynespal is just being realistic I think.
I can't see how Imogen could win such a case - she wasn't forcd into making the tape, and their agreement to delete the contents is just hearsay.

She had better forget about it and move on. If she harps on about it now, people will just remember her because of a seedy VHS, rather than her personality, and the positive image she is currently projecting.

I am sorry this was a private thing it shouldn't have been done she was foolish to delete it. Why would she have been so bothered with her image in the house if wanted all and sundry to see it.

It is out of order and I hope he is sued. It could ruin here chances of the career she hopes for because people will struggle to take her seriously and judge make crude remarks about her.......

She was foolish to go along with her then boyfriends wishes

But I seriously empathise with her...........

I totally sympathise with her too, and you're right it was a foolish deed... but foolish deeds have consequences.

Therfore I'd think, that, in the cold light of the law, she wouln't have a leg to stand on

I doubt anyone paid that much, sounds like media overhype. It's Imogen from Big Brother, not a really big star.

The man doesn't own the tape unless he got her to sign a consent form, which isn't remotely likely, or she wouldn't be pursuing a legal avenue. In fact any lawyer would tell her to drop it.

Not only can she have everything he earned from it, she can also sue the firm who marketed it for far more, as they are supposedly a wholly legit firm trading through high street chains, who would know better than to release a tape where it would seem hugely implausible she would ever have given consent, and they should have demanded proof before releasing it. They will need to pay the equivalent of all their earnings from it and damages.

If he genuinely made 120,000 then they obviously made more, and Imogen will clear more than half a million in total.

Agreed.Imogen certainly gave permission for the tape to be made but i doubt she gave permission for it to be made public.She would have had to sign a 'model release' form allowing the tape to be made public.

I doubt any such form exists.
