Item removed on eBay

I had an item removed on ebay here is a email reply explaining why from TOMTOM:-

The reason we notifies eBay about your listing was because your ad give the impression that you are selling a version of TomTom that can run onto another device then a TomTom compatible device. Listing a software program without offering a license is not permitted.

my advert on ebay clearly stated POI software for speed cameras, will work on TOMTOM one series, TOMTOM Navigator, TOMTOM Rider.

not only am i furious at their febble excuse but look at the spelling mistakes

what can I do to get this auction up and running again? I am sure they will write back and give another poor excuse.

You may well not be able to list it again. If you put it up and it is spotted and removed again by ebay they may very well suspend your account. It may well have been done by a 'jobs worth' there a few people on ebay who go round looking for slightly iffy auctions and report them for fun. This is probably what happened. Not to say your auction is iffy, but to some it is as it is secondary software fro another system and probably not allowed under ebays t & c's. So put it up if you wish the risk, but personally I wouldn't.

I personally wouldn't list it again, as the previous poster said, you could end up with a ban.

On with the main point, maybe your listing was in Copyright breach, and you didn't realise? Please tell us exactly what you were selling for us to give you more info on the legal side of things

i was selling POI software, for putting onto a sat nav program, tomtom design their products for you to put these things on them.
Just like selling a mobile phone ringtone

Is the software open source or closed? If its open, you cannot profit from it.

There's only two speed camera databases for TomTom that I know about - TomTom's own, and PocketGPSWorld's.
Neither grant redistribution rights.
