Hey im looking for some help . any imput will be helpful

I have a SE K800i from phones4u and i have had nothing but problems.

My phone keeps hanging up when i make a call or when somebody makes a call to me within seconds it goes dead. So i took the phone back and they sent it off for repair and when it came back still the same problem. So i have sent it back 5 times now and still it comes back with the same problem. And they denied there was a problem. So we explained when we took the chip out and put it in my samsung phone it made calls and we had no problems what so ever. So it had to be the phone. Even phones4u tried in the shop to make calls on it and they couldnt. Yet still it wasnt fixed.

So 3 weeks ago phones4u sent it back again and they said i would get a new phone this time . So after waiting 3 weeks and no new phone i chased them up and the company where like " there is nothing wrong with the phone so we have sent it back to you " and there will be no new phone.

So now we have got to the point where we wanna cancel the contract. As on a 18 month contract and been on the contract for about 5 months and in that time the phone hasnt worked for 4 of them months.

Yet when we asked to cancel our contract phones4u where completey unhelpful and said we couldnt cancel when we asked why they said " you just cant"

So just wanted to ask on here.

Is it possible to cancel our contract ? as surely they are in breach of the contract.

Sorry for the long story but thought it better to explain.

ps contract is with O2

I have had a similar problem years ago. Go to Citizens advice, they will give you a draught letter to give them stating "fit for the purpose" etc. Its amazing how fast a new replacement phone can come when the shop is threatened with legal action.

Trading Standards online and this link takes you to the page about mobile phones and your rights:

http://www.consumerdirect.gov.uk/bef...mobile-phones/

and the link for the template letters....

http://www.consumerdirect.gov.uk/aft...plate-letters/

On the site it gives you the top ten complaints to trading standards about goods and services in 2006 and number 2 is mobile phones.
