So could this dalek go back before the time war, and change it so the daleks survive, does this then place a dilema for the doctor, does he break the fundimentals of time, and does he go back further in time, maybe this time to rid us of the daleks

Probably with that is that the Time War wasn't at a particular "time". And Dalek's and Timelord's have been erased from Time and Space. The Cult of Skaro only managed to survuve because they were in the void.
