This is a great deal found on Hotdeals for a Nokia Phone have
a look.....http://shop.o2.co.uk/phone/Nokia/5300_Black

Only problem is they don't have any. They are advertising it as in stock but it isn't. They will take your money and send you 3 emails more or less together then 4 hours later they will send you another email saying it is out of stock and they will reimburse you within 28 days.

A very handy way to make money, lots of interest to be made on thousands of peoples debit/credit cards.

I know this is a bit of a rant but they did exactly the same thing to me December last year. How, in the age of the computer can they advertise something as in stock, take the money and then realize 'oh sorry it's out of stock'.
There should be a law against this ..... imo it's a CON.

It basically IS illegal, false advertising at the very least, you should complain to the relevant body who should look into it.

Why not tell O2 first you are complaining to an advertising body and see if you can get a deal out of them? Low line rental, extra minutes, texts etc.

LION8TIGER, I think you should be very careful with what you say. All you know is what happened to you. To extrapolate from that to accusing O2 of deliberately defrauding thousands of people could get you into trouble.
I don't know how this happened and don't defend the out of stock situation. Its frustrating for you, but ranting won't actually achieve anything.
My advice to you is to complain to O2, who knows what goodwill gesture they will make to apologise to you.

I don't know why i should be careful about what i say, i'm just saying exactly what happened (twice) and expressing an opinion. I don't think o2 would particularly want to sue me as it would not be a great advert for them.
I just got off the phone to them and they could give me no valid reason apart from stock control problems that they have.They will ring back later. Oh by the way it's still being advertised as in stock. They have the phone but not the bundle.

You are not saying exactly what happened, you quite clearly say they are doing it to get interest on thousands of peoples credit/debit cards. I didn't say O2 will sue you, where did you get that from?
I said you could make trouble for yourself, if you were O2 would you want to help someone who in their own words has a rant.
If I were you I would calmly, politely and insistently complain. Technical problems do happen, but if you were careful you could get a very good deal (as the other poster said above).

Sorry i thought that was what you meant by the word trouble, i couldn't think of anything else. I have calmed down now even though i have got nowhere, my poor wife has to put up with the ranting it's just the way i am i suppose ... i hate getting conned. As of 4pm today they have not taken the payment but that does not mean they wont.

I phoned customer services and got talking to one of the managers but all she could do was sympathise. She was not able to tell me anything about payment to o2 and suggested i go to my bank to see if it had been taken from my debit card. She said there were ongoing problems with stock control and promised to phone me back, but of course it's friday afternoon, bank holiday coming up ...... i'm still waiting for the call.
If they take the money out over the weekend i will complain
to the ASA and see what happens. It's now 26 hours since they sent me an email saying it was out of stock but it's still advertised as in stock on their website. I would have thought the manager would have phoned the 'webteam' and let them know. A reason why i am so annoyed is to be found in a post of mine from Dec '06 ........................

Yeh sure a genuine problem thats been going on for at least
9 months, maybe u haven't quite got the jist of it.
Anyway they took the money today and on their site now it's up to 10 days delivery ....... So i'll twiddle my thumbs ....

Call your credit card company and get the transaction reversed. If I know o2 it will still be a pending transaction anyway.

Its the reason I'm porting back out to Vodafone. I joined o2 a month ago and since then its been problem after problem.

Had 3 top-up transactions fail and yet they still took the money but didnt top up my account.

Max number of minutes you can buy as a bolt on per month: 50. Thats right, so if like me you talk alot you are stuffed.

So its back to Vodafone...who I should never have left

if you are seriously asking us to concur with your view that 02 are out to con you out of your £ 40 or item


Sounds more like a genuine cock up to me

Deliberate con or not, the system employed by o2 for cc payments results in money being taken before stock is checked as available. Of course for those working to a budget they may have to wait for o2 to refund/release the funds back to card before they can purchase a new phone.

Its not a mistake, its the way the system works, so unlikely to be an isolated incident.

Well i don't know if it's a deliberate con or not really. What i do know is that they have got my money for something they said they would deliver next day ( last Friday ) but it's Monday and i'm none the wiser, total lack of information from them, no email or phone call to let me know what's going on. It's back to
'up to 10 days delivery' from 'in stock' showing yesterday on their website.
The only other time i bought a phone from o2 on the web, exactly the same thing happened.

You might try ringing 0161 705 5000 and asking for the finance department. Its very possible that they can release the funds back to the card immediately rather than waiting for the automated system to do it.

Well this is going to be my last post on this subject until i get the matter resolved i'm sure you'll be glad to hear !

Thu ... Ordered phone on web for next day delivery, got 3 emails confirming and email 4 hours later 'out of stock' although website says 'in stock' until Sat, when it's '10 days delivery'
Sun .... 'in stock' in the morning, '10 days delivery' for the rest of the day.
Mon .... '10 days delivery'
Tue ..... 'in stock' for most of the day, '10 days delivery' since.

I phoned today when i saw it was back in stock with next day delivery but it's very hard to get through to customer services that can deal with you if you don't already have an o2 mobile number to give them .... so i rang Sales, no problem getting through there and was told they were definitely in stock and he would 'push' my order through and i would 'definitely' get my phone by the end of the week and to expect an email from them. I got the email an hour later GREAT, i thought, until i read it. It was a repeat of the automated email saying 'out of stock'. On Sunday when i saw it back 'in stock' i managed to get through to them , they checked and told me it was back in stock.

Anyway i got the email today, phoned them up 0870 number ( but me using 0800 alternative ) took 50 mins for them to answer to be told i was phoning the wrong no. but got put through and the lady said she could not access my account because i did not actually have an o2 phone. Yes that's the whole point i said, but fair play to her she contacted whoever and came back to me saying it's out of stock and i would be credited my £49.99 within 28 days. She also told me that i cannot talk on the phone to anyone about a phone i have ordered on their website, i can only email them.

So that's what i will do later on explaining what's happened
and if i don't have matters resolved to my satisfaction within 24 hours i will be on to the ASA with a copy of the same email.
Do you think that's fair enough

I have never complained to an official body in my life but i feel o2 are taking the p**s.

If anyone ordered the phone i did on the 23rd , 24th, 26th,
or the 28th Aug ( today ) they're probably in the same boat as i am.
I won't finish this off by saying o2 stinks or anything like that ... oh alright then .... THEY DO !!!!!!!!!!

I'd still be contacting my credit card company and asking them to claw the money back. I would also contact trading standards. You might also want to ring that number I gave you and ask for the chairmans office so that you can complain.

Pretty crappy cs anyway. Hope you get a result

Thanks Steve, the deal was actually done on a debit card, whether that makes any difference, i don't know.

Somehow i doubt i'd get past the person who answered the phone .... but you never know.

What i have done is emailed complaints@o2mail.co.uk and given them a link to the start of this thread because it gives a good explanation of what happened and i've been over it so many times now.............
Maybe it's not a wise move but i've had enough and if nothing else it might give them a good laugh in the o2 office
