I suspect that that condition is just in there to dissuade foreigners from applying. As if they didn't have it then you could have all celeb wannabes from all over the world all applying to all of the different BB's, which is just going to double, triple or quadruple the amount of applications that the staff would have to wade through.

All Big Brother housemates would have signed a contract with Endomol, whether they are from the UK, Africa, Australia or wherever. The housemates are under contract with Endomol until the end of their respective series', so if there was such a clause it would be easy enough to add an amendment on.
