iPod Software Update

I've never had a problem with my 5th Gen 30gig White Apple iPod, but recently, it asked to install a software update.

About 12 hours after installing it, the ipod crashed and a sad face icon appeared.

I forced it into Disk Drive and fixed it as much as I could, but it kept freezing, now it's back to the sad face icon, and I can no longer but it into disk drive.

I no longer have my warranty, but could I prove it's the software that caused it, or could I get software to uninstall the update?

Could just be a conincidence that it decided to die after the software update. I've updated mine and it's working fine. Sounds like a hardware fault with yours.
