What are my rights?

I purchaced a SE W580i from carphone werehouse on friday, payasyougo.

Every now and again it restarts, Not often, but when i go through the menu sometimes it will.

I tried an update, I also tried a master reset and it still does it.

I took it down today, They told me they will not replace it if it doesnt happen in store,

but it doesnt do it all the time, just now and again, and within the 10minutes i was in there with a que behind me and i shouldnt have to wait down there for however long untill it does it.

What can i do about this?

Im not happy that a 3day old phone does this and all they will do is put notes on the system.

I'm surprised that they treated you like that. This is a well known fault with the phone, so they should have been prepared.
However, if an item should prove faulty you must not attempt to repair it, you must immediately return it and reject it as faulty. The supplier can then choose whether to refund, repair or replace.

You should have a 14 day cooling off period, where you can either change phone, or change contract. Some networks only allow you to change the contract though - but obviously if its a faulty phone, you should get one no matter what. Tell them to take it in to the workshop.

My step father in law gets the same problem with his SE K850i... which is a common fault apparently. Have a look on esato.com to see if anyone gets the same problem with your phone model.

EDIT: Never mind, prking just explained it is a known problem. Demand a replacement, and dont leave the shop until you get one. Dont back down, the last thing the staff and manager wants is someone causing a fuss infront of other customers and they will soon sort it out.

Now what do you think, I rang customer services, they said there is no period where it can be exchanged, they have to see the fault and if they cant see it while i am there, they will keep it in for a day or two,

but why should i be without the phone that i bought new only three days ago from them?

Sadly that is the risk someone takes when buying from CPW or P4U. Why not try Sony Ericsson?

Sony Ericsson would be even longer. You would have to post it, they would keep it in to fix it, then send it back. Id rather give it to CPW for a day or two. If you have insurance with them, they will give you a temp phone.

Im planning on going down tomorrow, I want it replaced, it still does it now and again and im not happy.

It shouldnt have to stay in there, there must be something its coverd by, its only 3/4 days old.

Any advice on what i should say/do?

any Acts i can print out like the sales of good act or anything?

Im just trying to get ready for when i go down in the evening, So i can get my point accross and a replacement.

Go when its quite busy and speak loudly (not shout or swear) but loud so other customers can hear about how stupid the customer service is and you regret buying from there.
