I'm with Orange. I've had a few of these texts in the past, and generally thought nothing of it as I used to only skim-read my bills. It's outrageous that they can charge premium rates for sending an unsolicited text.

After sending my complaint to PhonePayPlus and emailing SmartMedia a few choice words, I remembered that my mobile number is also registered with tpsonline. Hopefully PhonePayPlus will definitely be able to take some action as, as far as I'm aware, it's illegal for UK companies to make unsolicited calls/send texts to phone numbers registered with tps.

I've had no reponse from Smart Media as yet.

I think it Should be the NETWORKS that take action as they
have far more clout than us.
Surely it must come under Invasion of Privacy and more so the Goverment should nip it in the bud.
I wonder if the Networks would take action if they got a Big Fine for allowing it.

I have just been scammed again in a similar manner to last month, though this time o2 advise me the company involved is Big Red Giant. I will of course go down the complain/get refund road but it's all getting very tedious.

Presumably the companies involved make a lot of money from this scam as not everybody checks and realises they have been charged for the unsolicited text.

After an earlier posting, and my complaint to Phone Pay Plus (and 80 odd others too) Spread Media were fined £20,000, given a formal reprimand, and suspended from operating for 6 months because of breaches under the Code of Practice.

I am now taking them to County Court for a refund and compensation - any one else want to join in?

Still think the phone operators (e.g. Vodafone) are highly complicit by allowing fraud to happen under their noses, and not protecting customers from what is effectively theft.
