The Jaffa Cake. Biscuit or Cake?

General consensus seems to be that biscuits go soft when stale, cakes go hard, making the Jaffa Cake a cake.

Clue's in the name really, there is basically no reason at all why it could be considered a biscuit with a bit of common sense applied!

Biscuit means "twice baked". Clearly Jaffa cakes are not. That's it.

Biscuit means "twice baked". Clearly Jaffa cakes are not. That's it.
I can't think of any other biscuits that are twice baked though. Does it really mean that?

Didn't McVities have to go to court as the government thought it was a biscuit and wanted to tax them more? In response, McVities produced a supersized version, to show that it was clearly a cake. Think a similar thing happened recently with M&S, with the government having to give them a rather large refund due to one of their cakes being taxed as a biscuit. I'd Google it myself, if I wasn't dribbling on my keyboard at the thought of a giant Jaffa cake.

I can't believe people actually think they're biscuits, despite the fact they're called cakes and have a cakey taste! Is it because they're small and round?!

I think we can agree, though, that they are delicious.

Also, why are cakes classed as an essential for tax purposes?! I think a lot of people in this country could do with eating LESS cake, to be honest...

Yes - and flattish, and they come in a pack all stacked together, like biscuits! And when I used to eat them (before I was vegan) they would go crunchy in my cookie jar. And when I would ask the kids what biscuits they wanted, they would say "Jaffa Cakes!" They are biscuits, damnit!!!

I think we can agree, though, that they are delicious.
Yes, they were my favourite biscuits. I'm sure I've said in a previous Jaffa Cake thread on here that one day, I'm going to make a huge vegan jaffa cake and scoff it all to myself!

In the famous legal case on this issue, McVities won by baking a giant Jaffa Cake, thus convinced the judge that it was a genuine mini-cake.

Well, that's as may be. And indeed the giant one I intend to make will be a cake. But small ones will always be biscuits to me, at least until they make them cake-shaped. Oh yes, they have - Jaffa Cake Bars! Now they are cakes without a doubt!

Apparently McVities had to prove it was a cake in a legal case, so made a large version to prove that it was, in fact, a cake.

That was always the deciding factor for me - the crunch (or lack of). Biscuits crunch, cakes don't. Can't say I've ever had the pleasure(?) of munching on a crunchy jaffa cake though
