got an email saying it's old stock & Tesco couldn't supply

thats despite they took my money for it - and they promised me refund

legally i dont think they are allowed to do that (taking money concludes 'an agreement') but i'm not making a fuss because play.com are sending it me anyways - albeit not quite as cheap

.
This has been argued over and over on DS, and I think the conclusion has always been that you will just get a refund and that they're not doing anything illegal. Big companies like this have T&C's in place to protect themselves in case of accidental errors like this.

you can reach an agreement even without money changing hands

once money does change hands the case is water tight

If anything, I personally feel that customers like you are just being unreasonable and would rather kick up a big fuss going on about laws instead of just accepting it as a tiny mistake. If you're getting your money back, what's the problem? These things are bound to happen with computerised systems. I'm not going to get into an argument about it because I don't know enough or care enough to do the research. As I said, each time this discussion has come up, the buyer has got their money back and that's been the end of it. Enough of this thread being taken OT now.

Yeah - stupid idea to have a reserve, can't be much higher than it is now, still could save about £100 though. I was watching on the comet clearance site and some fool paid £320 for a 32gb touch - £283 on apple site!
