Tomtom Sat nav stuck in shop demo mode

Hello,

I bought a new Tomtom One from Curry's the other day. It was annoying upon opening the packaging to find the device wasn't brand new and had been opened previously as the screen had a couple of finger prints on it and the screen's protective cover was stuck on the manual booklet, not one for making a fuss I continued to use the device.

Either if a route is planned or not and the device's touch screen isn't used for 3 minutes or so the device goes into "shop demo mode", by that I mean it starts displaying static demo screens of the devices menu system and functions. I have to tap the screen to get it back to seeing my planned route. I've looked all over the settings menu's and can't find anywhere to turn this off. I've sent a support ticket to Tomtom directly but still no reply. Has anyone experienced this before and know a way to get rid of it?

If it was sold to you as new then they have broken the law. So take it back.

Don't even bother trying to get it fixed.

Take it back , you say you bought it new , this has had shop use and an application put on it by the sound of it . Complain and ask for a new one and a free case for your trouble or walk , offers are plentiful at the moment.

Thinking about it some more I have to agree that it has some extra software stuck on it. As far as I know there is no such thing as a Shop Demo mode on a TomTom. At least I have never found it on the three i hav e owned and no-one has ever mentioned it on any of the speciallist GPS forums (fora?) I look at.

So if Currys sold it to you as new and not as ex demo then you have every right to go back and demand it be replaced with a brand new one.

Basically they have broken one of the main clauses of the Sale Of Goods Act which states...

Wherever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i.e. not inherently faulty at the time of sale).

Which means that if you were not told that it was an ex-demo model then it is not "as described" so you can reject it.

You are NOT making a fuss just exercising your legal rights.

Upon checking the files on the Tomtom I found this directory. It's going back first thing in the morning, I'm not happy!

Well I don't have nor have I ever had a folder called Script on any of my TomToms. So looks like you have indeed been sold a duff unit.

I would print off the page I linked to above, just in case you get any grief from Currys (not exactly a remote possibility!) And in particular the questions section, especially number 9.

Q9. Must I accept a credit note instead of a refund?

It depends on why you want to return the goods.

• If you have changed your mind, then the shop doesn't have to do anything.

• But if the goods are faulty, incorrectly described or not fit for purpose, then you are entitled to your money back (provided you act quickly), and you certainly don't have to take a credit note

• If you do accept a credit note in these circumstances, watch out, as there may be restrictions on their use.

• If the shop displays a sign stating they only give credit notes instead of refunds, they might be breaking the law and you could report them to Consumer Direct on 08454 04 05 06. Consumers in Northern Ireland should contact Consumer Line on 0845 600 6262.
