The rules aren't all that matters. Contestants in tv show are rightly criticised for many things that aren't against the rules. Rule-breaking is actually one of the less common criticisms.
Indeed, it's an odd defence to make -- and John's the one who started using the rules that way -- when they haven't been accused of breaking them. It makes me wonder whether he knew they were doing something questionable that was nonetheless within the rules.
