I kinda have mate ^ Jailbraked isn't even a word, even Jailbreaked would have been ever so slightly better.
Matt-08: how can you be sure? You don't know where or from whom the OP bought the iPod. It may have been jailbroken in the past, indeed it might still be if the OP doesn't know what apps should be installed by default. Rather than just saying "No, it hasn't" then concentrating on bad grammar you could have explained the situation fully to someone clearly confused.
Killjoy: chances are it won't have been jailbroken. If you do a full restore with iTunes then your iPod will be restored to it's factory state even if it has in the past been jailbroken. Jailbreaking causes no permanent changes or damage.
The reason for the question was that I just wanted to know if it was possible by looking at the software build to see if I could download non-apple applications.
